The site suffers from severe EDB and DBCP contamination around the pesticide mixing and storage area and due to a 500 gallon spill in 1977 that caused unsafe levels of DBCP and EDB in local drinking water three years later. The United States of America and the State of Montana are filing suit against Asarco, Atlantic Richfield Company and Arco Environmental Remediation under the CERCLA, demanding the removal of a massive mine tailings impoundment that has caused unsafe levels of cadmium and zinc to appear in drinking water. Jeremy and Clara McGlamry, as the natural parents of Ian McGlamry, deceased, are filing suit against Northwest Airlines and Pinnacle Airlines, alleging plaintiff Clara was pushing her neurologically impaired child in a car seat that was in a wheelchair supplied by defendant. The suit alleges when she pushed the wheelchair into an elevator the child fell out, struck his head, and died.
